PUTRAJAYA, January 7 — Former Prime Minister Datuk Seri Najib Razak has secured approval to initiate judicial review proceedings, seeking to compel the government to enforce a supplementary decree from the former king allowing him to serve the remainder of his prison term under house arrest. The Court of Appeal, in a 2-1 ruling, also permitted Najib to present new evidence in the High Court when the case is heard on its merits.
Justice Firuz Jaffril noted that Najib met the criteria under Ladd & Marshall for introducing new evidence, including a recently obtained copy of the decree from the Pahang ruler, who served as the 16th Yang di-Pertuan Agong. Despite Najib’s correspondence with six key respondents, including the home minister and attorney-general, no replies were received. Firuz and Justice Azhahari Kamal Ramli ruled in favor of Najib, while Justice Azizah Nawawi dissented.
