KUALA LUMPUR, December 22 — Former prime minister Datuk Seri Najib Razak will continue serving his six-year jail term at Kajang Prison after the High Court ruled that the Yang di-Pertuan Agong’s add-on order for house arrest was invalid.
High Court Judge Alice Loke Yee Ching ruled the order did not comply with Article 42 of the Federal Constitution and was not deliberated during the Pardons Board meeting, meaning the government has no duty to enforce it.
Najib’s lead defence lawyer Tan Sri Muhammad Shafee Abdullah confirmed that his client will appeal the decision, while also noting that other avenues such as parole or a new pardon request remain possible.
Shafee highlighted that with the one-third remission typically granted for good behaviour, Najib could potentially be released earlier than his scheduled August 2028 release, possibly as soon as August 2026 if the RM50 million fine from the SRC case is paid.
