PUTRAJAYA, July 1 — The Court of Appeal has dismissed an appeal against the Penang South Reclamation (Silicon Island) project after ruling the judicial review application was filed out of time.
In its written judgment, the court also held that the Penang planning authorities had no legal power to approve reclamation works because the proposed site lies within Malaysia’s territorial sea.
Which remains under federal jurisdiction until reclamation is completed. Despite that finding, the appeal by seven fishermen and two environmental groups was dismissed on procedural grounds.
With the court making no order as to costs due to the case’s public importance.
