KUALA LUMPUR, Dec 8 – The former Umno member Anina Saaduddin had failed in her bid to challenge her dismissal from the party after the Kuala Lumpur High Court today had struck out her suit on grounds that it had no jurisdiction to hear the case.

Judicial Commissioner S. Nantha Balan said a provision in the Societies Act on the finality of a decision by a political party stood in Anina’s way and denied her access to justice. In his judgment, Nantha Balan said Anina lost her membership because she filed a suit against party president Datuk Seri Najib Razak and not over disciplinary problems.

He said the membership of the plaintiff as the party members will fall automatically when the plaintiff violated the party constitution. In the meantime, he also added that the court also does not have any jurisdiction to hear and determine disputes within the party.

On September 11, Tengku Adnan issued two letters on September 1 and 2 over her termination. The former Langkawi Umno Wanita leader filed the suit against the secretary-general. She the two termination letters issued by Tengku Adnan was invalid, claiming that the letter does not have the constitutional power in Umno and / or law to remove her from the party.
